Recent research on the metaethical beliefs of ordinary people appears to show that they are metaethical pluralists that adopt different metaethical standards for different moral judgments. Yet the methods used to evaluate folk metaethical belief rely on the assumption that participants interpret what they are asked in metaethical terms. We argue that most participants do not interpret questions designed to elicit metaethical beliefs in metaethical terms, or at least not in the way researchers intend. As a result, existing methods are (...) not reliable measures of metaethical belief. Paul (2014, 2015) argues that the possibility of epistemically transformative experiences poses serious and novel problems for the orthodox theory of rational choice, namely, expected utility theory — I call her argument the Utility Ignorance Objection. In a pair of earlier papers, I responded to Paul’s challenge (Pettigrew 2015, 2016), and a number of other philosophers have responded in similar ways (Dougherty, et al. 2015, Harman (...) 2015) — I call our argument the Fine-Graining Response. Paul has her own reply to this response, which we might call the Authenticity Reply. But Sarah Moss has recently offered an alternative reply to the Fine-Graining Response on Paul’s behalf (Moss 2017) — we’ll call it the No Knowledge Reply. This appeals to the knowledge norm of action, together with Moss’ novel and intriguing account of probabilistic knowledge. In this paper, I consider Moss’ reply and argue that it fails. I argue first that it fails as a reply made on Paul’s behalf, since it forces us to abandon many of the features of Paul’s challenge that make it distinctive and with which Paul herself is particularly concerned. Then I argue that it fails as a reply independent of its fidelity to Paul’s intentions. (shrink)

This paper explores the possibility that Hobbesian jurisprudence is best understood as a ‘third way’ in legal theory, irreducible to classical natural law or legal positivism. I sketch two potential ‘third theories’ of law -- legal pragmatism and legal dualism -- and argue that, when considered in its broadest sense, Leviathan is best viewed as an example of legal pragmatism. I consider whether this legal pragmatist interpretation can be sustained in the examination of Leviathan’s treatment of civil law, and argue (...) that the pragmatic interpretation can only be successful if we can resolve two textual issues in that chapter. First, while Hobbes argues that law entails the existence of public (sharable) reasons, he does not adequately defend the view that the sovereign is the unique authority over such reasons in all cases, especially as far as they concern known collective emergencies. Second, Hobbes both affirms and denies that a sovereign can fail to do justice, which is paradoxical. Both problems are best resolved by legal pragmatism, though the second problem resists a fully satisfying resolution. The upshot is that, although Leviathan ought to be regarded as an episode of legal pragmatism, there are trade-offs on every reading. (shrink)

In this paper, I outline a theory of social kinds. A general theory of social kinds has to set out at least three conditions: existence conditions, persistence conditions, and identity conditions. For the sake of expediency, I focus on the existence and persistence conditions. The paper is organized just as life: first with existence, then persistence. I argue that anti-realism is more attractive than realism as an account of the existence conditions, despite the fact that realism has been under-appreciated. Then (...) I argue for a particular theory of the persistence conditions, which I call the basic overlapping traits theory (BOTT), based on an analogy to an approach to personal identity. The upshot of the argument is that from an anti-realist metaphysics we have the capacity to discuss a wider diversity of social phenomena. (shrink)

This paper argues that it is prudentially wise to defer to groups about how they are essentially constituted and defined. After a few words situating the paper in my greater research project (§1), I articulate the kind of deference I have in mind (§2). Then I offer two conditional arguments on why it is epistemically desirable to let other people tell you how they ought to be identified (§3). The first argument is that people are owed lexical sovereignty because denying (...) it is absurd; the second is that modest skeptics ought to agree with it on the basis of some relatively anodyne and plausible epistemic considerations. Le differenze cognitive tra individui sono dovute a una varietà di abilità mentali o a una sola? Questo articolo discute gli elementi centrali della teoria dell’intelligenza generale proposta da John Duncan nel volume How intelligence happens, tradotto recentemente in italiano e corredato da un capitolo conclusivo inedito. Prendendo le mosse dalla ricerca di Charles Spearman sull’intelligenza (...) generale e sui test d’intelligenza, Duncan caratterizza l’intelligenza nei termini di integrazione e controllo cognitivo. I dati neuroscientifici raccolti da Duncan suggeriscono che questi aspetti chiave del comportamento intelligente siano realizzati da un circuito cerebrale, chiamato multiple-demand system, in grado di scomporre problemi complessi in sotto-problemi più semplici e integrare informazioni da varie aree del cervello. ENG: How does our brain generate that sort of flexible and goal-directed behaviour that we call intelligence? Are individual differences in intelligence due to a variety of cognitive abilities or do they depend on one single mental ability? In this commentary, I revise and critically assess the key elements of John Duncan’s theory of general intelligence presented in the popular-science book How intelligence happens, recently translated into Italian and edited by F. Pavani, with a new final chapter. Starting from Charles Spearman’s research on a general intelligence factor and psychometric tests, Duncan advances a theory that characterises intelligence in terms of integration and cognitive control. Neuropsychological and neuroimaging data suggest that such key aspects of intelligent behaviour are realised by a brain network called a multiple-demand system, which is capable of decomposing complex problems into simpler sub-problems and then integrating information from different brain areas. Robert Kraut has proposed an analogy between valuing a loved one as irreplaceable and the sort of “rigid” attachment that (according to Saul Kripke’s account) occurs with the reference of proper names. We wanted to see if individuals with Kripkean intuitions were indeed more likely to value loved ones (and other persons and things) as irreplaceable. In this empirical study, 162 participants completed an online questionnaire asking them to consider how appropriate it would be to feel the same way about (...) a perfect replica of a loved one, as well as other questions about replaceability. Participants who previously had endorsed Kripkean reference (n = 96) rated loved ones as less replaceable on two different measures than participants who had previously endorsed Descriptivist reference (n = 66, t(160)> 2.27, p <.02, eta2> .03). Additional results suggest that this difference extends to other targets as well and is at least partially dependent on sentimental attachment. (shrink)

What follows is an attempt to do some conceptual housekeeping around the notion of secret law as provided by Christopher Kutz (2013). First I consider low-salience (or merely obscure) law, suggesting that it fails to capture the legal and moral facts that are at stake in the case which Kutz used to motivate it. Then I outline a theoretical contrast between mere obscurity and secrecy, in contrast to the 'neutral' account of secrecy provided by Sissela Bok (1989). The upshot of (...) the two sections is that low-salience law is neither secret law nor necessarily problematic, though it closely resembles a kind of law that is both secret and problematic: namely, those legal obscurities that subvert manifest interests related to the informational needs of citizens. The ensuing argument undermines the fiction of constructive presence found in Austin and Blackstone. (shrink)

The very idea of promulgation has been given little to no treatment in the philosophy of law. In this exploratory essay, I introduce three possible theories of promulgation: the ‘no-theory theory’ (which treats promulgation as a matter of particular contexts), the ‘conveyance theory’ (which treats promulgation as a function of intellectual good faith interpreters), and ‘agonistic theory’ (which treats promulgation as indistinguishable from propaganda). I suggest that (at least) three kinds of models are consistent with the theories, and can potentially (...) help us understand when law is successfully promulgated in particular legal contexts: the spread model, the chain model, and the memetic model. I end the paper by comparing the two theories with respect to a case study. Throughout I will show that the conveyance and agonistic theories have a serious advantage over the no-theory theory, in that they allow us to comparatively examine the epistemic weaknesses of diverse theories about the grounding of law on the basis of their contents. There at least three ways of thinking about rationality: instrumental, substantive, and intentional. By far, the instrumental account is most influential. This essay proposes that intentional rationality can provide substantive accounts with room to breathe, and in a way that is facially distinct from instrumental accounts. I suggest that the intentionality of a judgment is made up of what it is about and the orientation through which it is judged, while irrationality is the subversion of a strict supporting connection between (...) the judgment and its corresponding set of coordinated attitudes (reasons). It follows that irrational intentionality is made up of episodic states where a judgment is subverted because of a misalignment between what it is about and the way the judge is oriented towards its contents. Four examples of irrational intentionality are considered: passivity towards ends, constitutive ignorance towards facts, delirious paranoia towards objects, and a disjunctive orientation towards categorizations. In this paper I argue that textualism is far less attractive as a theory of written law than some of its modern proponents think. For it is not usually sensible to expect the grammatical meaning of a provision to determine its appropriate legal meaning. Nicole Hassoun’s sufficientarian theory is based on a particular conception of caring, which she calls ‘care, simpliciter’. However, ‘care, simpliciter’ is not described in any detail. This essay tries to offer a critical revision of Hassoun’s concept of care in a way that would put the MGL theory on its strongest footing. To that end, I will contrast her view with a taxonomy of care that supplements the accounts of care provided by Stephen Darwall and Lori Gruen. The concept of sustainable development considers environmental, social and economic issues in general. And the goals of resource conservation and socio-economic development do not contradict each other, but contribute to mutual reinforcement. The purpose of this study is to build and test an economic and mathematical model for the formation of strategies for the behavior of an economic entity with an increase in the impact of negative environmental factors. The proposed strategies and their models are based on the income-expenditure balance (...) equation, which takes into account both quantitative and qualitative characteristics. The constructed models are considered in the state space. The research methodology is based on building models in the form of linear combinations of functions of a homogeneous external impact and various spatial combinations of economic sources (sinks). The study makes it possible to assess the dependence of the amount of resources used for life support on the chosen adaptive strategy. Within the framework of the proposed model, it was found that the criterion for the effectiveness of the applied strategy can be an indicator of satisfaction with the state, the preservation of which, simultaneously with the preservation of the size of resources used, corresponds to the direction of optimization. This approach is consistent with the concept of sustainable development. (shrink)

As a contribution to a wider discussion on moral discernment in theological anthropology, this paper seeks to answer the question “What is the impact of mental illness on an individual’s ability to make moral decisions?” Written from a clinical psychiatric perspective, it considers recent contributions from psychology, neuropsychology and imaging technology. It notes that the popular conception that mental illness necessarily robs an individual of moral responsibility is largely unfounded. Most people who suffer from mental health problems do not lose (...) the capacity to make moral decisions, and mental illness on its own rarely explains anti-social or criminal behaviour. Moreover, the assumptions of some scientists, that recent developments in neuropsychology and brain imaging suggest biological determinism, must be treated with caution. (shrink)

In Pietroski ( 2018 ) a simple representation language called SMPL is introduced, construed as a hypothesis about core conceptual structure. The present work is a study of this system from a logical perspective. In addition to establishing a completeness result and a complexity characterization for reasoning in the system, we also pinpoint its expressive limits, in particular showing that the fourth corner in the square of opposition (“ Some_not ”) eludes expression. We then study a seemingly small extension, called (...) SMPL +, which allows for a minimal predicate-binding operator. Perhaps surprisingly, the resulting system is shown to encode precisely the concepts expressible in first-order logic. However, unlike the latter class, the class of SMPL + expressions admits a simple procedural (context-free) characterization. Our contribution brings together research strands in logic—including natural logic, modal logic, description logic, and hybrid logic—with recent advances in semantics and philosophy of language. Next, we develop an algorithmic approach for computing the complement of the single valued neutrosophic graph. A numerical example is demonstrated for computing the complement of single valued neutrosophic graphs and uniform single valued neutrosophic graph.

From his earliest work forward, phenomenologist Maurice Merleau-Ponty attempted to develop a new ontology of nature that would avoid the antinomies of realism and idealism by showing that nature has its own intrinsic sense which is prior to reflection. The key to this new ontology was the concept of form, which he appropriated from Gestalt psychology. However, Merleau-Ponty struggled to give a positive characterization of the phenomenon of form which would clarify its ontological status. Evan Thompson has recently taken up (...) Merleau-Ponty’s ontology as the basis for a new, “enactive” approach to cognitive science, synthesizing it with concepts from dynamic systems theory and Francisco Varela’s theory of autopoiesis. However, Thompson does not quite succeed in resolving the ambiguities in Merleau-Ponty’s account of form. This article builds on an indication from Thompson in order to propose a new account of form as asymmetry, and of the genesis of form in nature as symmetry-breaking. These concepts help us to escape the antinomies of Modern thought by showing how nature is the autoproduction of a sense which can only be known by an embodied perceiver. (shrink)

Inducing the rubber hand illusion (RHI) requires that participants look at an imitation hand while it is stroked in synchrony with their occluded biological hand. Previous explanations of the RHI have emphasized multisensory integration, and excluded higher cognitive functions. We investigated the relationship between the RHI and higher cognitive functions by experimentally testing task switch (as measured by switch cost) and mind wandering (as measured by SART score); we also included a questionnaire for attentional control that comprises two subscales, attention-shift (...) and attention-focus. To assess experience of RHI, the Botvinick and Cohen (1998) questionnaire was used and illusion onset time was recorded. Our results indicate that rapidity of onset reliably indicates illusion strength. Regression analysis revealed that participants evincing less switch cost and higher attention-shift scores had faster RHI onset times, and that those with higher attention-shift scores experienced the RHI more vividly. These results suggest that the multi-sensory hypothesis is not sufficient to explain the illusion: higher cognitive functions should be taken into account when explaining variation in the experience of ownership for the rubber hand. (529) Indeed her claim is true, but it is fallacious as she mistakenly ascribes the wrongfulness of such relationships to friends taking each other’s opinions seriously. But the mere consideration of unethical views is not a moral fault but a virtue and a skill. Kamm’s sore throat case gives us a choice: save one life, or save a distinct life and cure a sore throat. We defend the fairness explanation of the judgement that one should flip a coin to decide whom to save: it is disrespectful to let a sore throat act as a tie-breaker, because an individual would be forced to forgo a 50% fair chance of living (given to them by a coin flip), which cannot be outweighed by any number of (...) sore throats. We show that this explanation of when and why claims can permissibly break ties generates new problem cases for theories of aggregation, including theories that have been thought to accommodate the judgement that one should flip a coin in Kamm’s sore throat case. Godel, and John von Neumann were among its first recruited members. -/- Our team has for many years now gone through various research problems. Still, it is difficult for even experienced and highly accomplished researchers to identify the type of IAS “useless knowledge” problems. But we never stopped trying. -/- Our latest try has led to the informational entropy-based definition of value. At first, it sounded weird for one to ponder the long-existing notion of value, which is used on a daily basis by everybody on Earth. In short, kind of... useless. But gradually, we have come to an understanding that the very familiarity of the word “value” has long obscured our question of its nature. -/- So, a bit about this newly minted definition is here for your perusal. The Principle of Identity of Indiscernibles (PII) is the focus of much controversy in the history of Metaphysics and in contemporary Physics. Many questions rover the debate about its truth or falsehood, for example, to which objects the principle applies? Which properties can be counted as discerning properties? Is the principle necessary? In other words, which version of the principle is the correct and is this version true? This thesis aims to answer this questions in order to show that PII (...) is a necessarily true principle of metaphysics. To accomplish this task, the reader will find, in this thesis, an encyclopaedical introduction to the history of PII and to the reasons it matters so much, followed by a presentation of the most famous arguments against it and the defences used against these arguments. Then, the reader finds in-depth discussion of the minutiae involved in postulating the principle as to make clear what is in fact being attacked and defended. With these preliminaries solved, a deeper analysis of these defences is presented aiming to discover which is the most appropriate example to use against the attacks to the principle. This analysis allowed a classification of these defences in four families with different strategies within them. Finally, with these defensive strategies at hand we are able to confront alleged counterexamples to PII in Mathematics with the intention to test these defences. (shrink)

Introdução: O útero é um órgão reprodutivo localizado entre as cavidades abdominal e pélvica. Possui a capacidade de abrigar o embrião, mantê-lo acomodado durante a gestação e ajustar-se ao seu crescimento. Também auxilia na expulsão do mesmo, na hora do parto, por meio de contrações (SILVA, 2020). A reprodução equina é um âmbito crescente dentro da equinocultura, e possui um alto potencial comercial e econômico (NEIS, 2018). Portanto, o presente trabalho traz uma breve revisão de literatura, em relação ao principal (...) órgão do sistema reprodutor, o útero. Objetivo: O presente trabalho busca caracterizar o útero equino, acerca de suas características gerais. Desenvolvimento: Em equinos, o útero é constituído por dois cornos curtos, unidos pelo ligamento intercornual, um corpo longo, e uma cérvix ou colo, caracterizados por sua estrutura tubular, em forma de ¨Y¨ (SILVA, 2020). Histologicamente, esse órgão é formado por três camadas. A mais interna é a camada mucosa ou endométrio, seguida pela camada muscular lisa ou miométrio e a camada serosa ou perimétrio que recobre todo o útero externamente (FEITOSA, 2020). A fixação e sustentação uterina ocorrem por meio de uma porção do ligamento largo do útero: o mesométrio, o que permite sua localização estável entre as cavidades pélvica e abdominal (SILVA, 2020). Sua vascularização acontece pela artéria uterina, oriunda da artéria ilíaca interna, e pela veia uterina (KONIG; LIEBICH, 2021). Os ramos simpáticos dos plexos uterino e pélvico são responsáveis pela inervação deste órgão, o que permite a sua comunicação com o sistema nervoso central (SILVA, 2020). A cérvix ou colo do útero é a porção mais caudal desse órgão. Essa fica localizada entre o útero e a vagina, e delimita as porções interna e externa dessa região, uma vez que possui uma musculatura circular bem desenvolvida (FEITOSA, 2020). O lúmen da cérvix é revestido por células secretoras de muco, responsáveis por proteger o útero, impedindo a entrada de agentes ou facilitar o transporte de espermatozoides na cavidade uterina, através da lubrificação. A função do muco varia de acordo com a fase do ciclo estral que o animal se encontra, pois, durante o período de estro o muco exerce a função de lubrificação da cérvix para o momento da cópula, por isso apresenta um aspecto fluido. Já no período denominado diestro, a função do muco se limita à proteção, apresentando um aspecto viscoso (BETTENCOURT, 2018). Portanto, a principal função da cérvix é proteger o útero, a partir de sua musculatura forte e da produção de muco, exceto no período de estro e no momento do parto, onde a musculatura permanece relaxada e a composição do muco irá priorizar a lubrificação do canal vaginal e da cavidade uterina (KONIG; LIEBICH, 2021). Conclusão: O presente trabalho reuniu, através de uma revisão literária, características gerais, acerca da morfofisiologia uterina, evidenciando sua importância dentro do sistema reprodutivo, e a necessidade do seu bom funcionamento. Portanto, é indispensável o conhecimento da anatomia e fisiologia deste órgão, uma vez que ele apresenta uma importante função na reprodução equina, como supracitado nesta revisão. (shrink)

About six weeks ago, our post referred to the long-winding path to a new theoretical innovation as the pursuit of “useless knowledge” in Flexner’s terms. That little creation is the freshly minted informational entropy-based definition of value, presented in a very short paper, initially regarded by its authors as a research note. (And it still is.) Well, only two and a half months since its birth, this new concept of value has had enough time to power up several of our (...) publications in different disciplinary fields. The first published paper using the new definition deals with climate change denialism. The second paper (forthcoming) discusses the problem of academic retractions amidst the growing influence of generative AI. And the third, just accepted, explains the underlying mechanism of submission mechanism employed by journal editors and peer-reviewers, and the information-value nexus associated with it. (shrink)

Increasing evidence from psychology and neuroscience suggests that emotion plays an important and sometimes critical role in moral judgment and moral behavior. At the same time, there is increasing psychological and neuroscientific evidence that brain regions critical in emotional and moral capacity are impaired in psychopaths. We ask how the criminal law should accommodate these two streams of research, in light of a new normative and legal account of the criminal responsibility of psychopaths.
